Supreme Court Justice David Crerar Tuesday the\u00a0Canadian Society for the Advancement of Science in Public Policy would seek\u00a0both a lump\u00a0sum to punish the province for breaching charter rights and specific amounts tailored to damages alleged by individuals<\/p>\n\n\n\n<p class=\"has-text-align-left\"><q>Potentially, there would be three million individualized trials<\/q>\u00a0the judge asked<\/p>\n\n\n\n<p class=\"has-text-align-left\"><q>Potentially,<\/q>\u00a0Furtula responded<q>But of course, that doesn&#8217;t mean there would have to be actual trials. There&#8217;s ways that this can be achieved that are practical<\/q><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">&#8216;Punishing a whole group&#8217;<\/h2>\n\n\n\n<p class=\"has-text-align-left\">The exchange came on the second day of a week-long proceeding in B.C. Supreme Court in Vancouver to determine the future of the proposed class action lawsuit<\/p>\n\n\n\n<p class=\"has-text-align-left\">The CSASPP&#8217;s website says\u00a0the group is a\u00a0<q>non-profit, non-partisan, secular, crowd-funded, and volunteer-driven organization that was created in response to popular community demand for a direct action initiative to counter B.C.&#8217;s COVID-19 related measures<\/q><\/p>\n\n\n\n<p class=\"has-text-align-left\">According to their notice of claim, the group believes Dr. Bonnie Henry and the province\u00a0<q>invoked extraordinary executive powers predicated on unsubstantiated scientific and legal grounds with catastrophic consequences for British Columbians<\/q><\/p>\n\n\n\n<p class=\"has-text-align-left\"><q>The [Public Health Act]\u00a0orders do not discriminate between the sick and the healthy, collectively punishing a whole group,<\/q>\u00a0the claim reads<\/p>\n\n\n\n<p class=\"has-text-align-left\"><q>The reality is that either all or some of the ministerial orders were not necessary to &#8216;prevent, respond or alleviate&#8217; the effects of COVID-19 to the population of British Columbia<\/q><\/p>\n\n\n\n<p class=\"has-text-align-left\">The proposed claim says the measures violated a variety of rights guaranteed to Canadians under the Charter of Rights and Freedoms<\/p>\n\n\n\n<p class=\"has-text-align-left\">The CSASPP is seeking certification of a\u00a0class action lawsuit on behalf of all adults\u00a0residing or doing business in the\u00a0province who have suffered injury or\u00a0damages as a result of public health orders issued after March 17, 2020<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">&#8216;Angry, depressed, lonely and isolated&#8217;<\/h2>\n\n\n\n<p class=\"has-text-align-left\">The hearing was well attended by supporters of the CSASPP\u00a0\u2014 which put a call on its website for people to\u00a0<q>join us at this historic public hearing<\/q><\/p>\n\n\n\n<p class=\"has-text-align-left\">If certified, Furtula said the suit would have three subclasses:\u00a0328,000 people who saw\u00a0medical procedures\u00a0delayed or cancelled, 376,752 people who were not double-vaccinated and did not get exemptions and\u00a037,000 people who weren&#8217;t\u00a0vaccinated for religious reasons<\/p>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" data-src=\"https:\/\/images.radio-canada.ca\/q_auto,w_700\/v1\/ici-info\/16x9\/call-for-people-to-attend-court.png\" alt=\"The Canadian Society for the Advancement of Science in Public Policy posted a call on its website for people to attend the class action certification hearing in B.C. Supreme Court this week.PHOTO:&nbsp; (CANADIAN SOCIETY FOR THE ADVANCEMENT OF SCIENCE IN PUBLIC POLICY)<\/figcaption><\/figure>\n\n\n\n<p class=\"has-text-align-left\">The lawyer read portions from a number of affidavits that spoke to the wide range of complaints from people hoping to be part of the lawsuit<\/p>\n\n\n\n<p class=\"has-text-align-left\">In one, a single mother who was diagnosed with lung cancer during the pandemic complained that she was unable to get a second dose of vaccine in the 21-day period recommended by the manufacturer<\/p>\n\n\n\n<p class=\"has-text-align-left\">In another, the mother of a child whose classmate tested positive for COVID-19 was upset that her family was told to quarantine despite the fact they all tested negative for the virus<\/p>\n\n\n\n<p class=\"has-text-align-left\">And in another, the\u00a0<q>angry, depressed, lonely and isolated<\/q>\u00a0head of a technology company\u00a0said he was shunned because he was unvaccinated and unmasked \u2014\u00a0unable to participate in group activities or meet potential romantic partners<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">&#8216;There has to be a coherent plan&#8217;<\/h2>\n\n\n\n<p class=\"has-text-align-left\">Crerar\u00a0doesn&#8217;t have to decide the merits of the case, but he\u00a0has to determine if the lawsuit meets the requirements needed for a class action\u00a0\u2014 which include\u00a0common issues, an identifiable class of people\u00a0and an appropriate person to represent the class<\/p>\n\n\n\n<p class=\"has-text-align-left\">The judge also has to decide whether a class action lawsuit is the proper way to resolve the dispute<\/p>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" data-src=\"https:\/\/images.radio-canada.ca\/q_auto,w_700\/v1\/ici-info\/16x9\/preuve-vaccin-covid-colombie-britannique.JPG\" alt=\"Under the terms of B.C. health orders, anyone who wanted access to a range of non-essential indoor services had to show proof of vaccination. A group is now seeking to certify a class action lawsuit against the province in relation to those measures.PHOTO:&nbsp;GOV.BC.CA<\/figcaption><\/figure>\n\n\n\n<p class=\"has-text-align-left\">In his exchange with Furtula, he pointed out how varied the possible claims are \u2014 ranging from\u00a0people who were upset they couldn&#8217;t get vaccinated fast enough to\u00a0people who didn&#8217;t want to get vaccinated at all<\/p>\n\n\n\n<p class=\"has-text-align-left\">He asked the lawyer for other examples of class action lawsuits which have been brought about based on alleged charter breaches or in relation to COVID restrictions<\/p>\n\n\n\n<p class=\"has-text-align-left\">Furtula pointed to a lawsuit in the United States where members of the military are challenging mandatory vaccination<\/p>\n\n\n\n<p class=\"has-text-align-left\">While helpful, the judge said that proceeding was an example of a single-issue complaint where everyone is\u00a0<q>rowing in the same direction<\/q><\/p>\n\n\n\n<p class=\"has-text-align-left\"><q>I get your point, that you&#8217;re saying these orders are no good, they&#8217;re imprecise, they&#8217;re not tailored, they&#8217;re irrational, they&#8217;re not consistent,<\/q>\u00a0he told Fortula<\/p>\n\n\n\n<p class=\"has-text-align-left\"><q>But in terms of implementing how the trial is going to unfold,\u00a0and how if you&#8217;re successful at trial, damages are going to be awarded, et cetera, there has to be a coherent plan for the logistics of that and addressing potential internal contradictions<\/q><\/p>\n\n\n\n<p class=\"has-text-align-left\">The Crown will make its case later this week<\/p>\n\n\n\n<p class=\"has-text-align-left\">In a response filed with the court, the government denies the claim, saying\u00a0the health orders were made in accordance with\u00a0<q>national and international surveillance data<\/q>\u00a0as well as\u00a0<q>local, national and international epidemiological data<\/q><\/p>\n\n\n\n<p class=\"has-text-align-left\"><q>The overriding concern is to ensure that [Public Health Act]\u00a0orders and other public health guidance protect the most vulnerable members of the society while minimizing social disruption,<\/q>\u00a0the response says<\/p>\n\n\n\n<p class=\"has-text-align-left\">The province says the\u00a0CSASPP has failed to meet the requirements to certify a class action lawsuit on all fronts\u00a0<\/p>\n\n\n\n<p class=\"has-text-align-left\">And the Crown also says that any breaches of the Charter of Rights and Freedoms are allowed under Section 1 of the Charter, which allows governments to put limits on rights and freedoms so long as those limits\u00a0can be shown to be reasonable in a free and democratic society<\/p>\n\n\n\n<p class=\"has-text-align-left\">\u00a0CBC News\u00a0<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Advocacy group says lawsuit would seek damages on behalf of all adults in British Columbia The lawyer for a group seeking to certify a class action lawsuit against B.C.&#8217;s provincial health officer for damages allegedly caused by unjustified\u00a0COVID-19-related orders says the proceedings could result in as many as three million claims Polina Furtula told B.C.
