{"id":13701,"date":"2022-12-20T15:34:18","date_gmt":"2022-12-20T15:34:18","guid":{"rendered":"https:\/\/ambassadornews.org\/?p=13701"},"modified":"2022-12-20T15:34:22","modified_gmt":"2022-12-20T15:34:22","slug":"border-agency-using-radio-equipment-from-chinese-company-banned-in-the-united-states%ef%bf%bc%ef%bf%bc","status":"publish","type":"post","link":"https:\/\/ambassadornews.org\/en\/border-agency-using-radio-equipment-from-chinese-company-banned-in-the-united-states%ef%bf%bc%ef%bf%bc\/","title":{"rendered":"Border agency using radio equipment from Chinese company banned in the United States\ufffc\ufffc"},"content":{"rendered":"\n<p class=\"has-text-align-left\">Public safety minister orders department-wide review of procurement contracts with Hytera<\/p>\n\n\n\n<p class=\"has-text-align-left\">For the past five and a half years, the Canada Border Services Agency (CBSA) has been using communications equipment and technology from\u00a0the controversial Chinese firm\u00a0Hytera\u00a0Communications\u00a0\u2014 a company the United States government has banned\u00a0as a national security threat<\/p>\n\n\n\n<p class=\"has-text-align-left\">In response to CBC&#8217;s questions\u00a0about\u00a0CBSA&#8217;s use of Hytera equipment and technology, Public Safety Minister Marco Mendicino\u00a0said\u00a0he&#8217;s asked all departments across his portfolio\u00a0to review any\u00a0procurement contracts linked to Hytera or its subsidiaries in the wake\u00a0<a href=\"https:\/\/www.cbc.ca\/news\/politics\/rcmp-contract-firm-china-1.6676065\" target=\"_blank\" rel=\"noreferrer noopener\">of a controversy over a similar RCMP contract\u00a0(new window)<\/a>\u00a0with one of Hytera&#8217;s subsidiaries<\/p>\n\n\n\n<p class=\"has-text-align-left\"><q>I have instructed my department to do a portfolio-wide scan and review of any other potential similar contracts which may have been awarded, so that we can take whatever steps are necessary to mitigate any against any risks that may exist,<\/q>\u00a0Mendicino said Monday<\/p>\n\n\n\n<p class=\"has-text-align-left\"><q>That will apply\u00a0right across all departments, including the CBSA<\/q><\/p>\n\n\n\n<p class=\"has-text-align-left\">CBC\u00a0News\/Radio-Canada has learned that at the Fort Erie Peace Bridge in Niagara Region, CBSA officers are equipped with radios made by Hytera, a telecommunications company based in\u00a0Shenzhen, China.\u00a0China&#8217;s government owns about 10 per cent of Hytera through an investment fund<\/p>\n\n\n\n<p class=\"has-text-align-left\">Hytera\u00a0products are banned for sale and import in the United States. The United States Federal Communications Commission (FCC)\u00a0<a href=\"https:\/\/www.fcc.gov\/supplychain\/coveredlist\" target=\"_blank\" rel=\"noreferrer noopener\">has blacklisted the company\u00a0(new window)<\/a>\u00a0for posing\u00a0<q>an unacceptable risk to the national security of the United States or the security and safety of United States persons<\/q><\/p>\n\n\n\n<p class=\"has-text-align-left\">Hytera is\u00a0the owner of Ontario-based Sinclair Technologies. The federal government faced some pointed national security questions earlier this month when\u00a0<a href=\"https:\/\/www.cbc.ca\/news\/politics\/rcmp-contract-firm-china-1.6676065\" target=\"_blank\" rel=\"noreferrer noopener\">Radio-Canada reported\u00a0(new window)<\/a>\u00a0on\u00a0a contract between Sinclair and the RCMP to supply Mounties with\u00a0radio frequency (RF) filtering equipment<\/p>\n\n\n\n<p class=\"has-text-align-left\"><a href=\"https:\/\/www.cbc.ca\/news\/politics\/rcmp-suspends-contract-1.6678907\" target=\"_blank\" rel=\"noreferrer noopener\">The RCMP has since suspended the contract\u00a0(new window)<\/a>\u00a0and the Mounties say they&#8217;re reviewing the RF equipment\u00a0they&#8217;ve\u00a0installed<\/p>\n\n\n\n<p class=\"has-text-align-left\">In February\u00a02017, Public Services and Procurement Canada (PSPC)\u00a0<a href=\"https:\/\/buyandsell.gc.ca\/procurement-data\/contract-history\/47419-180625-001-QD-0\" target=\"_blank\" rel=\"noreferrer noopener\">awarded a contract\u00a0(new window)<\/a>\u00a0worth just under $3 million to Canquest Communications of Chatham, Ont., to provide digital mobile\u00a0radios and radio communication infrastructure for CBSA in the Niagara Region, which includes four points of entry<\/p>\n\n\n\n<p class=\"has-text-align-left\">A spokesperson for Procurement and Public Services Canada said the contract with Canquest did not include any security requirements<\/p>\n\n\n\n<p class=\"has-text-align-left\">Canquest worked with Hytera Canada to build the radio communications infrastructure\u00a0and sold Hytera radio equipment to CBSA<\/p>\n\n\n\n<p class=\"has-text-align-left\"><q>Hytera&#8217;s Tier III Pro design architecture is well suited for wide area public safety service,<\/q>\u00a0says\u00a0<a href=\"https:\/\/www.hytera.ca\/news\/canquest-communications-wireless-inc\" target=\"_blank\" rel=\"noreferrer noopener\">a 2017 Hytera news release\u00a0(new window)<\/a>\u00a0on the contract<\/p>\n\n\n\n<p class=\"has-text-align-left\">Canquest&#8217;s CEO John Smith\u00a0<a href=\"https:\/\/chathamvoice.com\/2017\/05\/02\/chatham-firm-inks-radio-deal-with-cbsa\/\" target=\"_blank\" rel=\"noreferrer noopener\">told\u00a0the Chatham Voice\u00a0(new window)<\/a>\u00a0community newspaper in 2017 that Hytera&#8217;s technology\u00a0<q>gave [Canquest] the edge<\/q>\u00a0in winning the bid<\/p>\n\n\n\n<p class=\"has-text-align-left\"><q>Hytera is a progressive company,<\/q>\u00a0Smith said in the article<q>They provide the Chinese police force with radios. This is incredibly flexible technology<\/q><\/p>\n\n\n\n<p class=\"has-text-align-left\">Three of the Niagara ports of entry are no longer using Hytera equipment, but the Peace Bridge port of entry still is and won&#8217;t transition to new radio equipment and a new network until March 2023<\/p>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" data-src=\"https:\/\/images.radio-canada.ca\/q_auto,w_700\/v1\/ici-info\/16x9\/peace-bridge.JPG\" alt=\"The CBSA border crossing at the Peace Bridge in Fort Erie. Border agents at the Peace Bridge will continue to use Hytera equipment until at least March 2023 after CBSA extended a procurement contract.PHOTO:&nbsp;LA PRESSE CANADIENNE \/ FRANK GUNN<\/figcaption><\/figure>\n\n\n\n<p class=\"has-text-align-left\">Responding\u00a0to questions from CBC\/Radio-Canada, CBSA spokesperson Rebecca Purdy\u00a0said the Peace Bridge border crossing hasn&#8217;t switched\u00a0because of technical issues that emerged during testing of the new radio network and equipment<\/p>\n\n\n\n<p class=\"has-text-align-left\">She said CBSA\u00a0did its own security assessment of the Hytera\u00a0equipment and technology<\/p>\n\n\n\n<p class=\"has-text-align-left\"><q>At the time the contract was put in place in 2017, CBSA was aware that Canquest,\u00a0a Canadian company, was a reseller of Hytera equipment,<\/q>\u00a0she said in an email statement<\/p>\n\n\n\n<p class=\"has-text-align-left\"><q>CBSA takes communications security seriously and has formal processes in place to assess communications security and mitigate risk. To date, these formal processes have not identified any risks to be mitigated for the Peace Bridge facility<\/q><\/p>\n\n\n\n<p class=\"has-text-align-left\">CBSA did not\u00a0provide answers to CBC\/Radio-Canada&#8217;s follow-up questions on the nature of that security assessment by the time this story was published<\/p>\n\n\n\n<p class=\"has-text-align-left\">Smith referred\u00a0CBC\/Radio Canada to CBSA\u00a0for comment. Hytera Canada has not responded to CBC\/Radio-Canada&#8217;s\u00a0request for comment<\/p>\n\n\n\n<p class=\"has-text-align-left\">Shortly after CBC\/Radio-Canada sent questions to CBSA, Alexander Cohen,\u00a0Mendicino&#8217;s press secretary, sent an email statement<\/p>\n\n\n\n<p class=\"has-text-align-left\"><q>We can confirm that the Canada Border Services Agency&#8217;s contract with Canquest Communications will expire in the near future, and that the Agency will replace its equipment with technology from another vendor,<\/q>\u00a0Cohen said in the statement<\/p>\n\n\n\n<p class=\"has-text-align-left\">A spokesperson for the Communications Security Establishment (CSE), Canada&#8217;s signals intelligence agency, said CSE\u00a0was never asked to do\u00a0a\u00a0security review of the equipment or contract<\/p>\n\n\n\n<p class=\"has-text-align-left\">Hytera is facing 21 espionage-related charges in the United States. The U.S. Department of Justice\u00a0<a href=\"https:\/\/www.justice.gov\/opa\/pr\/federal-indictment-charges-prc-based-telecommunications-company-conspiring-former-motorola\" target=\"_blank\" rel=\"noreferrer noopener\">has accused the company\u00a0(new window)<\/a>\u00a0of conspiring to steal technology from the American telecommunications firm Motorola<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Public contracts with Chinese company under scrutiny<\/h2>\n\n\n\n<p class=\"has-text-align-left\">Controversy over Hytera&#8217;s role in Canada&#8217;s\u00a0security infrastructure comes at a time of heightened tensions between Canada and China. The federal government&#8217;s Indo-Pacific Strategy,\u00a0<a href=\"https:\/\/www.cbc.ca\/news\/politics\/canada-china-trudeau-xi-taiwan-1.6664854\" target=\"_blank\" rel=\"noreferrer noopener\">released earlier this year\u00a0(new window)<\/a>, calls for a more aggressive Canadian foreign policy toward Beijing. China&#8217;s government has condemned the strategy<\/p>\n\n\n\n<p class=\"has-text-align-left\">Foreign Affairs Minister M\u00e9lanie Joly said earlier this month that the RCMP&#8217;s contract with Sinclair is inconsistent with the government&#8217;s approach to China outlined in the Indo-Pacific Strategy<\/p>\n\n\n\n<p class=\"has-text-align-left\">The House of Commons standing committee on industry and technology<a href=\"https:\/\/www.cbc.ca\/news\/politics\/commons-ministers-rcmp-china-contract-1.6682909\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a0recently called\u00a0(new window)<\/a>\u00a0Mendicino to appear before the committee to\u00a0answer questions about the RCMP contract with Sinclair<\/p>\n\n\n\n<p class=\"has-text-align-left\">The committee is also looking to question Fran\u00e7ois-Philippe Champagne, the minister of innovation, science and industry, about why Hytera was able to purchase Norsat International \u2014 Sinclair&#8217;s parent company \u2014 in 2017 without a government national security review of the transaction<\/p>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" data-src=\"https:\/\/images.radio-canada.ca\/q_auto,w_700\/v1\/ici-info\/16x9\/5g-cda-huawei.png\" alt=\"Minister of Innovation, Science and Industry Fran\u00e7ois-Philippe Champagne and Minister of Public Safety Marco Mendicino hold a press conference in Ottawa on May 19, 2022.
