Plaintiffs’ decision to sue defendants in the first place called into question<\/p>\n\n\n\n

An Ontario judge has dismissed a $1-million libel action by three nurses who faced disciplinary action for their anti-vaccine views during the pandemic,\u00a0calling the plantiffs’ decision to sue\u00a0puzzling<\/q>\u00a0and\u00a0surprising<\/q>\u00a0<\/p>\n\n\n\n

Kristen Nagle\u00a0of London, Ont.,\u00a0Kristal Pitter of Tillsonburg, Ont., Sarah Choujounian\u00a0of Toronto and the Canadian Frontline Nurses\u00a0filed their court action\u00a0under the province’s anti-SLAPP legislation\u00a0in December 2021,\u00a0(new window)<\/a>\u00a0alleging the Canadian Nurses Association (CNA) and independent B.C. news outlet Together News Inc. (TNI) caused harm to their personal and professional reputations with separate online articles published in the fall of 2021<\/p>\n\n\n\n

SLAPP,\u00a0which stands\u00a0for strategic lawsuit against public participation, is a legal manoeuvre\u00a0traditionally used by the rich and powerful to intimidate, silence and\/or bankrupt opponents. Ontario introduced legislation in 2015 designed to protect against such\u00a0gag proceedings\u00a0(new window)<\/a>\u00a0from using\u00a0the courts to silence expression on matters of public interest\u00a0<\/p>\n\n\n\n

In her 29-page decision\u00a0issued Dec. 23,\u00a0Superior Court Justice\u00a0Marie-Andr\u00e9e Vermette\u00a0sided with the defendants, saying the plaintiffs\u00a0failed to establish they have suffered sufficiently serious harmand\u00a0failed to show a causal link between the harm they allege and the publications in issue<\/q><\/p>\n\n\n\n

Vermette\u00a0cited the\u00a0anti-SLAPP legislation\u00a0(new window)<\/a>, saying there were\u00a0significantly more important sources of harm<\/q>\u00a0to the nurses’ reputations that were\u00a0unrelated<\/q>:\u00a0to the publications, including<\/p>\n\n\n\n

\u00a0Professional misconduct investigations of all three nurses by the province’s nursing regulator, the College of Nurses of Ontario (CNO)<\/p>\n\n\n\n

The fact all three nurses were terminated from their respective jobs with cause<\/p>\n\n\n\n

Numerous media reports about the the nurses, including articles by what the court called “high-profile media organizations”<\/p>\n\n\n\n

Vermette also called into question\u00a0the plaintiffs’ decision to sue in the first place, calling it\u00a0puzzling<\/q>\u00a0given that similar information appeared in\u00a0numerous<\/q>\u00a0other articles published in Canada<\/p>\n\n\n\n

She also said the decision to specifically sue TNIa small and regional media organization<\/q>\u00a0was\u00a0particularly surprising<\/q>\u00a0because the plaintiffs\u00a0chose to ignore similar expressions made by media giants<\/q>\u00a0<\/p>\n\n\n\n

‘No comment’ from plaintiffs’ lawyer<\/h2>\n\n\n\n

The CBC was specifically cited in the decision by Vermette, who noted Nagle\u00a0stated that CBC ruined her career and destroyed her life. The plaintiffs have not\u00a0sued CBC for libel<\/q><\/p>\n\n\n\n

CBC News attempted to clarify the statement made by Nagle, who\u00a0did not respond to a request for comment Wednesday\u00a0<\/p>\n\n\n\n

Alexander Boissonneau-Lehner, the lawyer for the plaintiffs, responded\u00a0no comment<\/q>\u00a0in an email when reached by CBC News on Tuesday<\/p>\n\n\n\n

The court’s decision to dismiss the lawsuit under anti-SLAPP legislation is the latest judgment\u00a0against anti-vaccine and anti-science groups attempting to use the courts to silence and intimidate critics\u00a0<\/p>\n\n\n\n

Until the COVID-19 pandemic,\u00a0SLAPP suits were the traditional tactic of the rich and powerful to bully critics into silence, but the\u00a0legal tactic has been\u00a0increasingly used lately by those\u00a0spreading\u00a0health misinformation\u00a0(new window)<\/a>\u00a0in an attempt to hush critics\u00a0<\/p>\n\n\n\n

Defendant calls action a ‘classic SLAPP suit’<\/h2>\n\n\n\n

This was a classic SLAPP suit in the sense they were just trying to shut us up<\/q>\u00a0Will Horter, editor of the VanIsle news network, which is owned by TNI, told CBC News on Tuesday<\/p>\n\n\n\n

CNA is very pleased that the court found that the public interest in protecting the CNA’s statement<\/q>\u00a0Lucas Veiga, the public affairs lead for the CNA,\u00a0wrote via text message Wednesday\u00a0<\/p>\n\n\n\n

CNA takes its role advocating for the nursing profession and the health-care system and the health of those living in Canada seriously<\/q><\/p>\n\n\n\n

Now that the judge has dismissed the lawsuit, all three parties must agree on costs<\/p>\n\n\n\n

Under Ontario’s anti-SLAPP legislation, defendants are entitled to full costs of the litigation\u00a0unless a judge determines otherwise<\/p>\n\n\n\n

Vermette wrote in her decision that she would hear arguments to determine damages in January\u00a0should the parties not be able to agree on costs\u00a0<\/p>\n\n\n\n
