And  where does it fall short\ufffc\ufffc"},"content":{"rendered":"\n<p class=\"has-text-align-left\">Accused people have a right to bail, but there are long-standing disparities in the system<\/p>\n\n\n\n<p class=\"has-text-align-left\">The head of Canada&#8217;s largest provincial police force strongly criticized the country&#8217;s bail system in the wake of an on-duty officer&#8217;s shooting death \u2014\u00a0drawing attention to a legal practice that is frequently misunderstood and beset with inequity<\/p>\n\n\n\n<p class=\"has-text-align-left\">Ontario Provincial Police\u00a0Commissioner Thomas Carrique said he was\u00a0<q>outraged<\/q>\u00a0that Randall McKenzie, the suspect alleged to have shot Const. Grzegorz Pierzchala on Dec. 27, was out on early\u00a0<a href=\"https:\/\/www.cbc.ca\/news\/canada\/hamilton\/opp-fatal-constable-shooting-1.6698594\" target=\"_blank\" rel=\"noreferrer noopener\">bail and had a lifetime ban\u00a0(new window)<\/a>\u00a0from owning a firearm\u00a0<\/p>\n\n\n\n<p class=\"has-text-align-left\">Carrique called for changes to the bail system\u00a0<q>to ensure that, where possible, people who are charged with violent offences that are firearms-related are not in those positions moving forward<\/q><\/p>\n\n\n\n<p class=\"has-text-align-left\">But many legal and justice experts say\u00a0calls for stricter rules around bail miss the bigger picture of structural issues in the justice system<\/p>\n\n\n\n<p class=\"has-text-align-left\"><q>Those problems are complex and deep and have very little to do with that moment at the beginning of the period of what could be somebody&#8217;s incarceration while they wait for a trial or in order to enter a guilty plea<\/q>\u00a0says M\u00e9tis lawyer Patricia Barkaskas, an assistant\u00a0professor with the University of Victoria&#8217;s faculty of law<\/p>\n\n\n\n<p class=\"has-text-align-left\">Here is a look at how bail works in this country, what issues exist within it and how it factors into the Canadian justice system<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">?Why does Canada have a bail system<\/h2>\n\n\n\n<p>Under the law, a person accused of a crime is presumed innocent until they are proven guilty. Granting them bail means they can remain out&nbsp;of jail while their case moves through the justice system \u2014 a process that&nbsp;can take many months.<\/p>\n\n\n\n<p class=\"has-text-align-left\">Canada&#8217;s bail system is based on English common law, dating back hundreds of years. To stop prisoners escaping from jails, and reduce the cost of incarceration, English courts began granting accused people bail, as long as certain conditions were met<\/p>\n\n\n\n<p class=\"has-text-align-left\">Much of that same system remains in place in Canada today. Under the Criminal Code,\u00a0a person has the right to a bail hearing within 24 hours of their arrest if a judge is available, or as soon as possible once a judge becomes available<\/p>\n\n\n\n<p class=\"has-text-align-left\">If they are denied bail, they will remain in custody. The financial cost\u00a0of keeping an accused person in jail is\u00a0<a href=\"https:\/\/www.legalaid.on.ca\/more\/corporate\/reports\/a-legal-aid-strategy-for-bail\/#section2\" target=\"_blank\" rel=\"noreferrer noopener\">far greater\u00a0(new window)<\/a>\u00a0than the cost of supervising them in the community while they await trial<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">MAN CHARGED WITH KILLING OPP OFFICER PREVIOUSLY RELEASED ON BAIL<\/h3>\n\n\n\n<p class=\"has-text-align-left\">17 hours agoDuration2:27A man charged in the shooting death of an Ontario Provincial Police officer had been released on bail while facing charges including assaulting a police officer and possessing a handgun<\/p>\n\n\n\n<p class=\"has-text-align-left\">Bill C-75, passed in 2019, included an amendment to the Criminal Code to introduce that\u00a0reverse onus for repeat offenders charged with an offence against an intimate partner<\/p>\n\n\n\n<p class=\"has-text-align-left\">The burden of proof for obtaining bail is also on the accused for certain firearms offences, said federal Justice Minister David Lametti,\u00a0as he reacted to the fatal shooting of the OPP officer<\/p>\n\n\n\n<p class=\"has-text-align-left\"><q>It is important to note that the bail laws are clear\u00a0that detention of an accused person is justified if it is necessary to protect the safety of the public,<\/q>\u00a0Lametti said<\/p>\n\n\n\n<p class=\"has-text-align-left\">Often, an accused will need a surety \u2014 a person who will promise to supervise their behaviour, and who will pay a certain amount of money if the accused breaches their bail conditions<\/p>\n\n\n\n<p class=\"has-text-align-left\">Bail conditions can include orders not to contact certain people, like a co-accused or an alleged victim, as well as curfews, restrictions on places they can go, and a requirement to not use alcohol or drugs<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">?Why might someone be refused bail<\/h2>\n\n\n\n<p class=\"has-text-align-left\">The\u00a0<a href=\"https:\/\/laws-lois.justice.gc.ca\/eng\/acts\/C-46\/section-515.html\" target=\"_blank\" rel=\"noreferrer noopener\">Criminal Code\u00a0(new window)<\/a>\u00a0lists three justifications for keeping a person accused of a crime\u00a0in custody: it&#8217;s necessary for making the accused attend court or for keeping the public safe \u2014 or to\u00a0<q>maintain confidence in the administration of justice<\/q><\/p>\n\n\n\n<p class=\"has-text-align-left\">On that latter point, a judge or justice of the peace can consider the seriousness of the alleged offence and the length of imprisonment it carries, as well as whether a firearm was involved and the\u00a0<q>apparent strength<\/q>\u00a0of the prosecution&#8217;s case<\/p>\n\n\n\n<p class=\"has-text-align-left\">Some of the reasons why bail might be denied include<\/p>\n\n\n\n<p class=\"has-text-align-left\">An accused&#8217;s criminal record, particularly if they have failed to comply with past bail conditions or court orders<\/p>\n\n\n\n<p class=\"has-text-align-left\">The accused is thought to pose an ongoing risk to the public<\/p>\n\n\n\n<p class=\"has-text-align-left\">Problems with their bail plan, such as not having a suitable place to live or not having a surety<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">?How many people are in jail\u00a0because they were denied bail<\/h2>\n\n\n\n<p class=\"has-text-align-left\">Many people in Canada&#8217;s jails\u00a0are\u00a0<q>legally innocent<\/q>\u00a0\u2014 that is, awaiting a bail hearing or\u00a0trial and likely to be released once their court cases are finalized, says Anthony Doob, emeritus professor at the University of Toronto&#8217;s Centre for Criminology and Sociolegal Studies<\/p>\n\n\n\n<p class=\"has-text-align-left\">In 2020, the most recent year for which data is available, about 77 per cent of people in Ontario&#8217;s jails\u00a0were in custody awaiting trial<\/p>\n\n\n\n<p class=\"has-text-align-left\"><q>We are not a lenient country, in terms of who we hold in jail awaiting trial,<\/q>\u00a0Doob told CBC News in an email<\/p>\n\n\n\n<p class=\"has-text-align-left\"><q>It is always easy, in retrospect, to suggest that certain accused people should have been held in prison awaiting trial. But it is very difficult to predict which ones we should imprison before trial<\/q><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">?What\u00a0inequities\u00a0exist in the current system<\/h2>\n\n\n\n<p class=\"has-text-align-left\">There are long-standing disparities between who gets bail in Canada, and who stays behind bars<\/p>\n\n\n\n<p class=\"has-text-align-left\">Indigenous people are\u00a0<a href=\"https:\/\/www.justice.gc.ca\/eng\/rp-pr\/jr\/gladue\/p2.html\" target=\"_blank\" rel=\"noreferrer noopener\">denied bail more often\u00a0(new window)<\/a>\u00a0than others, while Black people in Ontario spent longer in custody than white people did while awaiting trial on the same offences,\u00a0<a href=\"https:\/\/www.reuters.com\/article\/canada-us-canada-jails-race-exclusive-idCAKBN1CO2RD-OCADN\" target=\"_blank\" rel=\"noreferrer noopener\">Reuters reported in 2017\u00a0(new window)<\/a><\/p>\n\n\n\n<p class=\"has-text-align-left\">Many other marginalized groups \u2014 including people with mental health issues or substance use disorders, LGBTQ+ people, new immigrants and the less-wealthy \u2014 can all also face discrimination in the bail system, says\u00a0Jillian Rogin, an assistant professor in the faculty of law at the University of Windsor, Ont<\/p>\n\n\n\n<p class=\"has-text-align-left\">A key part of the problem, she says, is the main information that courts rely on at bail hearings: a police synopsis of the alleged crime and the accused&#8217;s criminal record, if they have one<\/p>\n\n\n\n<p class=\"has-text-align-left\"><q>It&#8217;s really problematic\u00a0because this is state evidence created for state purposes, and then the state relies on it to determine release or detention<\/q><\/p>\n\n\n\n<p class=\"has-text-align-left\">The surety system also disadvantages poorer people, Rogin said<\/p>\n\n\n\n<p class=\"has-text-align-left\"><q>If [an offender] doesn&#8217;t have a surety who has substantial means, or four sureties \u2014 it&#8217;s not uncommon to have three or four sureties \u2014 and tons of money, he won&#8217;t be released,<\/q>\u00a0says Rogin<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">?What happens if someone violates their bail<\/h2>\n\n\n\n<p>A person who fails to abide by their bail conditions can have their bail cancelled. They may have to go back to court for a new bail hearing, and prove why they should be allowed to remain outside of custody.
